A new decree on controls approved by the Minister Martina: "More transparency and greater consumer protection" (IT)

The Ministry of Food and Forestry Policies announces that the Council of Ministers has approved a draft legislative decree laying down rules for the harmonization and rationalization of legislation about controls on organic agricultural and agri-food productions. The new rule update a legislation that was approved in 1995, adjusting it at the light of the most recent European Regulations.

The Decree has the following objectives:

- to ensure greater consumer protection, as well as greater protection of trade and competition;

- to simplify and unify in a single text the legislation on controls in organic farming, making the system of controls more effective also in terms of repression.

"We want to keep the Italian organic sector stronger, more secure and more transparent," said Minister Maurizio Martina. "We are leaders in Europe as number of operators, and organic crops are progressively growing. We need to have high quality controls, to give more guarantees to honest consumers and producers. For this reason, we have introduced in a single text all the relevant provisions, and above all introduced provisions against conflicts of interest that occurred in the past. We make more accurate and transparent the relationship between controllers and controlled holdings, so as to strengthen the credibility of an absolutely strategic sector. "

"With this decree - said Deputy Minister Andrea Olivero - another step is being taken to strengthen the Italian organic sector and continue with the implementation of the National Strategic Plan approved last year”.

CONTROL SYSTEM

  • The decree confirms that Mipaaf is the competent authority for the organization of controls and that it  delegates these tasks to private and authorized control bodies;
  • ICQRF - the Central Inspectorate for Quality Protection and Fight against Fraud in Agri-Food Products issues authorizations to carry out controls, and it is therefore entitled to monitor the activities of the Control Bodies;
  • In order to strengthen the system, the Forestry-Carabinieri will control operators, and supervise control bodies.

RULES AGAINST THE CONFLICT OF INTERESTS BETWEEN CONTROL BODIES AND CONTROLLED UNITS

The rule introduces mechanisms to strengthen fair competition and eliminate conflicts of interest between control bodies. It states that:

  • organic operators can not hold company shares in control bodies;
  • Control Bodies can not control the same operator for more than 5 years;
  • Control Bodies must guarantee adequate experience and expertise of the human resources employed.

DATA BANK OF ORGANIC TRANSACTIONS AGAINST FRAUDS

The rule establishes a public database of all commercial transactions in the organic sector that can be used by all the operators within the system to make transactions more transparent and the anti-fraud action more timely, with greater consumer protection.
